These General Terms and Conditions of Sale apply to all orders placed via the websites www.etains-prince.com The company ETAINS DU PRINCE reserves the right to modify these General Terms and Conditions of Sale at any time. In the event of such modification, the General Terms and Conditions of Sale in force on the day of the placement of the order shall be enforceable.
The customer fills out the order form that is presented on the website. In order to confirm the order and initiate the sale, the customer must accept, fully and without reservation, the General Terms and Conditions of Sale. These same conditions shall be the only ones applicable to the contract thus concluded.
The commercial contract between the company ETAINS DU PRINCE and the customer comes into existence when the order is confirmed. The order shall be deemed to have been accepted by the company ETAINS DU PRINCE once the partner banking organisation has accepted the payment. After validation of the purchase order validated by the acceptance of
the General Conditions of sale and the data acquisition of payment, the
order becomes irrevocable, firm and final and can be retracted only
within the limits of the provisions relating to the time of
retractation specified with the article aiming at the “right of
withdrawal”. All commercial contracts impose obligations upon both of the contracting parties:
Insofar as the customer's order is accepted (acceptance of the General Terms and Conditions of Sale, confirmation of the order and payment accepted by the partner banking organisation), the company ETAINS DU PRINCE undertakes to deliver the products ordered to the address provided by the customer. It will provide the products ordered to the partner carrier within a period of no more than 72 hours worked after the acceptance of the order. Whether the customer's order is accepted or refused, the customer will receive confirmation thereof by e-mail only, within 24 hours worked (office opening hours) of the order being accepted or refused. The company ETAINS DU PRINCE reserves the right to refuse an order if the products ordered are unavailable or if there is a risk that the order received or the forthcoming delivery might prove to be problematic or if an anomaly appears during the placing of the order. It will have to inform the customer of this retractation within 48 hour
after initial acceptance, and to give order of refunding of the sums
possibly discharged within the same time.
The customer undertakes first of all to verify that the order has been confirmed and to indicate any error there may be in the order within a period of no more than 12 hours following the placement of the order. Any complaints or claims shall be made using the e-mail address created to this effect (edp@etains-du-prince.com) Furthermore, the customer undertakes to supply the company ETAINS DU PRINCE with an address to which the delivery may be made during the working hours of the day (during the hours worked). Last of all, the customer undertakes to pay the given price for the service or products provided by the company ETAINS DU PRINCE. If the given price does not include shipping costs, customs and excise duties and any other import taxes that may exist in the country of delivery (paragraph 4.1), the customer undertakes to pay, upon reception of the goods, all such additional expenses to the carrier of the company ETAINS DU PRINCE. The customer must under no circumstances sell on the products it purchases via the website of the company ETAINS DU PRINCE. All orders placed by a customer may only be used for his or her own personal use or for the personal use of the person on whose behalf the order was placed. In the latter instance, the customer guarantees the acceptance of the General Terms and Conditions of Sale by the final recipient of the delivery.
The overall price indicated by the company ETAINS DU PRINCE on the order confirmation is the definitive price of the order. ETAINS DU PRINCE reserves the right to modify its pricelist at any time, but naturally undertakes to apply the pricelist in force on the date of the order. The overall price given on the order confirmation may or may not include the cost of shipping, customs and excise costs and the taxes specific to the country of import.
Payment of the orders shall be made in Euros and US Dollars. Amounts given on the website in a currency other than the Euro and US Dollars are done so for purely informational purposes. The payment of orders shall be carried out by bankcard only, by means of the server of the company ETAINS DU PRINCE 's banking partner (NATEXIS Banques Populaires). This is a secure payment mode, because it means that none of the customer's banking information transits via the website of the company ETAINS DU PRINCE. The on-line payment may be made in complete safety, by entering the number of the bankcard, the date of expiry of the bankcard and the number of the visual cryptogram that is given on the back of the bankcard. The payment is made secure by means of the encryption of the customer's credit card details using the 128-bit SSL (Secure Socket Layer) protocol. The details of the customer's bankcard never transit visibly on the bank's server. Under no circumstances does the company ETAINS DU PRINCE have access to these details, nor are they kept on its servers. If a customer visits the boutique at www.etains-prince.com and places an order on several occasions, he or she will be obliged to fill out the bank details for the bank's server each time. The company ETAINS DU PRINCE reserves the right to refuse delivery to or to honour an order placed by a consumer with whom there exists an outstanding dispute with respect to payment.
In France The products shall be delivered by an express carrier (Colissimo) to the address given by the customer on the order confirmation. Abroad The products shall be delivered by express carrier (FEDEX, EXAPAQ or Colissimo) to the address given by the customer on the order confirmation.
The products shall be delivered within a period of between one (1) and nine (9) working days as from the date of the order confirmation. The lead times given to the company ETAINS DU PRINCE by its partner carrier vary according to the country. These average lead times are given for informational purposes on the Internet site and on the order confirmation sent to the customer. The company ETAINS DU PRINCE cannot be held liable for any overrun of the lead time given.
Within 24 hours worked of having placed the order, the customer will receive confirmation of the order by e-mail. This e-mail contains a summary of the order as well as the number of the shipping notice, which will enable the customer to monitor the progress of the package by connecting to the website of the carrier.
The customer has undertaken to supply an address to which the delivery may be made during the working hours of the day (during the hours worked). In the event that the recipient or any person able to take possession of the goods is absent at the time the package is delivered, the carrier will leave a non-delivery notice at the address given by the customer, in which the date and the hour of the attempted delivery will be stated. Any shipment that remains undelivered after three attempts shall be sent back to the nearest offices of the partner carrier and an attempt to inform the recipient shall be made. If the delivery address given by the customer is a private address ("residential" delivery), only one attempt to deliver shall be made subsequent to the initial delivery. If the shipment is not delivered after three (3) delivery attempts (two (2) attempts in the case of a private address) or has been kept for five (5) working days after the date of its reception and of its customs clearance by customs in the country of delivery, it shall be considered to be undistributable and shall be returned to the company ETAINS DU PRINCE. The company ETAINS DU PRINCE cannot be held liable for any damage incurred by the products in the event of the late collection, or non-collection, of the package by the customer.
The customer should check that the goods delivered comply with the order and are in good condition, before signing the delivery slip. Such verification shall be deemed to have been performed once the customer, or a person duly authorised to do so by the customer, has signed the delivery slip. All anomalies with respect to the delivery (damaged product, etc.) must be set out by the customer in the form of handwritten exceptions on the delivery, and signed. These exceptions may be expressed in writing with the carrier at the moment of delivery, or at the latest 12 hours after the delivery. A copy of such exceptions must be sent by e-mail exclusively to the company ETAINS DU PRINCE at the latest 12 hours after these exceptions have been expressed in writing (edp@etains-du-prince.com). The customer should, along with this e-mail, have the carrier confirm to ETAINS DU PRINCE that such exceptions have genuinely been expressed.
If the products ordered need to be returned to the company ETAINS DU PRINCE (non-conformity, damage, etc.), this must occur within seven days worked following the delivery. After this period, no claim will be accepted. The products must be sent back in their original state (packaging, catalogue, etc.), failing which they may be refused. All returns must be sent to the following address: LES ETAINS DU PRINCE It is essential that the customer use the services of the company ETAINS DU PRINCE 's partner carrier in order to return products. This is because the carrier has contractual links with the company ETAINS DU PRINCE which facilitate the various operations linked to international carriage (customs, taxes, payment). All returns must be accompanied by a copy of the invoice received when the package was received. The cost for returns shall be borne by the company ETAINS DU PRINCE, except in the case of withdrawal.
The customer is solely liable for the choice of products ordered, for their maintenance from the moment of delivery and for the use to which they are put. All the products presented on the www.etains-prince.com website comply with current French legislation.
The company ETAINS DU PRINCE certifies that all the products presented on the www.etains-prince.com website comply with current French legislation. In the event that the sold product is not conform, it may be returned to the seller who will take it back, exchange it or reimburse it. The buyer is responsible for the return transport costs.
Neither the company ETAINS DU PRINCE, nor the customer of the company ETAINS DU PRINCE may be held liable for failure to perform the sale contract thus concluded in the event of the occurrence of a case of force majeure, beyond their control, which shall include, and which list is not exhaustive, war, riots, insurrection, interruption to carriage, import or export problems, strikes, lock-outs, shortages, fire, earthquake, storm or flood.
In accordance with article L.121-16 of the French Code of Consumption, the consumer has a period of seven working days as from the receipt of the goods ordered in order to return any article with which he or she is unsatisfied and request that it be exchanged, without any penalty, with the exception of the cost of returning the goods. Any such return must be signified by e-mail at the address edp@etains-du-prince.com. The number of the order must be given in order for the complaint or claim to be handled.
The company ETAINS DU PRINCE undertakes to protect the personal data supplied by its customers. None of the customer's personal data that may be collected by the company ETAINS DU PRINCE shall be communicated to any third party. The customer has the right to access, modify, rectify or delete the personal data that related to him or her (Art. 34 of the &lquo; Information Technology and Civil Liberties » Act). In order to exercise this right, the customer must contact the company ETAINS DU PRINCE directly
If one of these General Terms and Conditions of Sale should be declared inapplicable or null and void for any reason whatever, this nullity or inapplicability shall not affect the application or the validity of the other provisions of the General Terms and Conditions of Sale. These General Terms and Conditions of Sale are exclusively governed by French law. The courts of Thiers (63) shall have sole jurisdiction for hearing any disputes relative to said Conditions.
